The Court is not against the live-in relationship but against the illegal relations-Allahabad High Court denies protection to married woman in live-in relationship

Prayagraj, 07 July – Allahabad High Court dismissed the petition filed by the petitioner and her live-in partner where she made averments to have voluntarily entered in a live-in relationship with him since 2015 because of apathetic and torturing behaviour of her husband.

The petitioner further stated that her husband is trying to endanger their peaceful life and she prays police protection.

The Standing Counsel for the State respondents submitted that this type of relationship cannot be supported by the Court as the division bench of this Court has already disapproved such acts in the case of Aneeta and another v. State of UP and others wherein, in similar facts and circumstances, it had dismissed the protection plea of a married woman living with her partner with an exemplary cost of Rs. 5000.

The court dismissed the petition with a view that it does not deem proper to permit the parties to such illegality as tomorrow petitioners may convey that we have sanctified their illicit relations. Live-in relationship cannot be at the cost of social fabric of this Country. Directing the police to grant protection to them may indirectly give our assent to such illicit relations.

The bench of Hon’ble Mrs. Renu Agarwal,J., clarified that this Court is not against live-in relationship but is against illegal relations.
