Persistent efforts of respondent wife to constrain the appellant to be separated from the family would be torturous for the husband and would constitute an act of cruelty- Delhi High Court

Hon’ble bench of the Delhi High Court in the instant case dissolved marriage on the grounds of mental cruelty and desertion by the wife.

The Court upon perusal of records and evidences observed that there was constant bickering and abuse by the respondent wife.

The Court further observed that the respondent wife made complaint to the CAW Cell for dowry demands but she failed to substantiate those allegations in the matrimonial proceedings by leading cogent evidences in her testimony. The Court relied on a catena of decisions by the Hon’ble Apex Court where it was held that unwarranted claims of dowry demands against the husband and his family members would constitute mental cruelty inflicted upon the husband and such claim can be ground of divorce.

In the view of facts and circumstances of the instant case and the perusal of evidences on record, the court dissolved the marriage on the grounds of mental cruelty and desertion by the respondent wife.
