The Bench of Hon’ble Justice Vivek Rusia quashed proceedings against the petitioners in matrimonial dispute.
The Court observed that the respondent wife executed a power of attorney in favor of her father to prosecute the case against the family members of the husband. The husband and the respondent wife are living in Australia.
The wife lodged FIR against the family members of the husband nearly after one year delay and failed to defend the false allegations of dowry demand and assault by cogent evidences.
The Court observed that nowadays there is a package of 5 cases against the husband and family members in family court and the criminal court under I.P.C., the Hindu Marriage Act and the Protection of Women from Domestic Violence Act, 2005.
The Court further observed that the cases have been filed by the respondent wife just to harass the family members of the husband. The parents of the husband are senior citizens and as per the contents of the FIR the husband was not even present in India.
Upon perusal of records and facts and circumstances of the case the Hon’ble Bench quashed the proceedings.
